What Usually Needs a Permit
Roofed structures: gazebos, A-frames, pavilions, covered patio and lanai extensions. These are permanent structures and almost always need a building permit.
Pergolas: attached pergolas usually need a permit, and many freestanding pergolas do too, depending on size and design.
Screen enclosures and screen rooms: new enclosures generally require a permit.
Outdoor fireplaces and kitchens: the structure, plus the electrical, gas and plumbing work, are typically permitted.
Electrical: new outdoor circuits, lighting, fans, heaters and hot tub hookups are permitted electrical work.
Every permitted structure gets its necessary engineered documents. Requirements depend on your exact project and property, so we confirm what yours needs before we design.
The Florida Building Code uses the national ASCE 7 wind standard, so design wind speeds vary by location, and areas designated wind-borne debris regions carry added requirements. Permitted structures are designed to Florida Building Code wind requirements.
How Permitting Works in Clay County
Confirm the jurisdiction. Unincorporated Clay County (including Fleming Island, Oakleaf and most Orange Park mailing addresses) is permitted by the County. Homes inside the Town of Orange Park are permitted by the Town.
Planning and Zoning site pre-review. In unincorporated Clay County, additions and accessory structures get a site pre-review before the building permit.
Apply online. Clay County permits are filed through the County's online self-service portal.
Plan review. The Building Division reviews accessory buildings, screen enclosures and similar structures under the Florida Building Code.
Notice of Commencement. Required for most permitted projects.
Inspections. Scheduled as the work progresses, through final.

Good to Know in Clay County
Certified Notice of Commencement. Clay County asks for a certified copy of the recorded Notice of Commencement, and it must carry the permit number.
Small-job exemptions don't cover most outdoor living work. A recent state law exempts some small, non-structural jobs from permitting, but not electrical, plumbing, mechanical, gas or structural work, or work in flood zones, so gazebos, patio covers, screen rooms and outdoor kitchens still need permits.
Town of Orange Park. Homes inside the Town's limits are permitted by the Town, not the County. Fleming Island and OakLeaf are County.
How We Handle It
We prepare the drawings and the necessary engineered documents, file the permit, respond to plan review comments and schedule the inspections. HOA approval and the permit are separate steps, and we handle both. We don't publish timelines because review times vary; we can start most projects within two to four weeks.
The Atlantic hurricane season officially runs from June 1 to November 30, with the peak around September 10, according to NOAA.

Frequently Asked Questions
Do I need a permit for a pergola in Clay County? Most attached or roofed structures need a building permit in Clay County, and many freestanding ones do too, depending on size and design. We pull the permits for you, and every permitted structure gets its necessary engineered documents.
Do I need a permit for a screen enclosure in Clay County?New screen enclosures and screen rooms generally require a permit. We handle the permit and inspections as part of the project.
How do I look up permits on my property in Clay County?Clay County has an online permit search (https://claycountyfl-energovpub.tylerhost.net/apps/selfservice/ClayCountyFL). We handle the filing and tracking for our projects and keep you updated, so you don't have to.
Does HOA approval replace the building permit? No. Your association's approval and the building permit are separate. Most communities want HOA approval first, and the permit office reviews the plans for code.
Who pulls the permit, me or the contractor? We do. We pull permits under our licenses and schedule the inspections as part of every permitted project.
Do I need a permit for a fire pit?Gas fire pits and built-in fire features usually involve permitted gas and sometimes electrical work. Wood-burning fire pits have local burn rules. We confirm what your project needs.
