Do I Need a Permit for a Pergola in Florida?
Short answer: often, yes. Here's how it usually works in Northeast Florida.
Whether a pergola needs a permit in Florida depends on whether it's attached to the house, its size and design, and your county or city. In Northeast Florida, attached pergolas usually need a permit and many freestanding ones do too. HOA approval is a separate step.

What Usually Needs a Permit
- Gazebos, A-frames, pavilions and covered patios: roofed, permanent structures that almost always need a building permit.
- Attached pergolas: usually need a permit. Freestanding pergolas: many do, depending on size and design.
- Screen enclosures: new enclosures generally need a permit.
- Electrical, gas and plumbing work: permitted separately or as part of the project.
Every permitted structure gets its necessary engineered documents.
The Florida Building Code uses the national ASCE 7 wind standard, so design wind speeds vary by location, and areas designated wind-borne debris regions carry added requirements. Permitted structures are designed to Florida Building Code wind requirements.
By County
Each county and beach city runs its own permit office. See our guides for Duval County, St. Johns County, Clay County and Nassau County.
Merriam-Webster describes a pergola as posts and beams holding up an open roof of girders and cross rafters, so it filters the sun rather than blocking it completely.
