Outdoor Fireplace Permits and Code Basics
The basics of permits, placement and clearances for outdoor fireplaces in Northeast Florida.
An outdoor fireplace is a permanent structure, and often involves gas and electrical work too. That means permits, placement rules and clearances. Here are the basics we plan for. Your exact requirements depend on your county, the fireplace type and your HOA.

What We Plan For
- Permits. The structure and any gas or electrical work are typically permitted. Gas connections are made by our licensed gas trade partners.
- Clearances. Distance from the house, structures, overhangs, trees and property lines.
- Under a roof. Fireplaces under a gazebo or covered patio are designed with the structure.
- Burn rules. Wood-burning fireplaces follow local recreational burn rules and burn bans.
- HOA review. Fireplaces are commonly reviewed for placement and height.
NAHB counts outdoor fireplaces among the home features that have grown most in popularity over the past decade.
Before leaving a fire, NFPA advises dousing it with water and making sure the area is cool to the touch.
